We recommend that you read these General Terms of Use carefully and in full. If you do not consent to these General Terms of Use, then please do not use this website. This website was developed and is administered by VIYOUU Softwareentwicklung GmbH (hereinafter referred to as VIYOUU). We reserve the right to change our website, the following General Terms of Use for this website and our General Terms of Use in accordance with section 9 in whole or in part, in our own discretion at any time without notice, and/or to discontinue their use. We therefore ask you to check this page again when you visit the website again and to take note of any amendments and/or additions.

2. Validity and scope of application

The use of the non-restricted websites offered by VIYOUU and all data, information and services available via these websites, with the exception of services that are subject to separate agreements, is permitted solely on the basis of these General Terms of Use.

These General Terms of Use may be supplemented, modified and replaced by additional terms in individual cases.

By commencing use of a VIYOUU website, you are deemed to accept the validity of the current version of these General Terms of Use.

3. Websites

We provide various data, information and applications for users to retrieve and download from our websites.

We are entitled to discontinue operating our websites in whole or in part at any time. Furthermore, we assume no liability for uninterrupted availability of our websites.

Some areas or services of our websites may be access- or password-protected. Therefore, in the interests of ensuring transaction security, access to these pages is only possible in certain cases if you register in advance. There is no legal entitlement to registration. Access to access- or password-protected websites is subject to the terms and conditions specifically available on the respective website.

In addition, we expressly reserve the right to make websites that were previously freely accessible subject to pre-registration.

Unauthorised use of these trademarks or other materials is expressly prohibited and constitutes an infringement of copyright, trademark rights or other intellectual property rights. All content provided on our general (non-restricted) websites is intended for personal, non-commercial use only, unless specifically designated otherwise.

Users may not edit, alter, copy, modify, supplement, reproduce, present, distribute, sell, rent, lend or in any other way make available or utilise the content provided on our websites without our prior express written permission.

Any other use, and in particular any commercial use thereof, without the prior consent of the operator or the respective rights holder is prohibited.

No licences or other rights of any kind whatsoever are granted to the respective user outside the expressly granted rights of use.

Please note that the information provided was up-to-date on the date it was published, but may now be out of date. For this reason, you should check any information you receive on our websites before using it in any way whatsoever. 

Users of our websites are deemed to confirm that they agree to access these websites and their content at their own risk. Neither VIYOUU nor third parties involved in the creation, production or transmission of our websites can be held liable for any losses or injury resulting from the access, use or inability to use our websites or from the fact that you have relied on information contained on our websites. VIYOUU accepts no liability for the correctness, accuracy, freedom from third-party property rights and copyrights, completeness and/or usability or permanent availability of the websites.

If content on our websites is provided free of charge, liability for material defects and defects of title is expressly disclaimed, unless wilful misconduct or gross negligence on our part can be proven.

Liability in cases other than those referred to above presupposes proof of wilful misconduct or gross negligence on our part. In general, we accept no liability for indirect losses, consequential losses or lost profits or for any loss of data or changes to data and information.

Although we endeavour to keep our websites and the content provided on them free from malware, we do not warrant that they are free from malware. Before using and downloading data or information, you as the user must independently take the necessary protective measures, such as putting the relevant security precautions in place.

Insofar as our websites contain links or references to third-party websites, these do not constitute approval of their content on the part of VIYOUU. VIYOUU therefore accepts no responsibility for the availability or content of such websites and no liability for loss or injury resulting from the use of such content of any kind. In addition, VIYOUU does not warrant that the information on a topic which is provided by these references and/or links will remain of the same quality without change. Accessing a link to such websites is at the user's own risk. The selection of references and/or links is not intended to limit you in any way to the information on the referenced or linked websites.

7. Information provided by the user

The individual user of our websites is fully responsible for all information sent to VIYOUU with regard to its content and accuracy and for ensuring that the rights of third parties are not infringed. The individual user agrees that VIYOUU may store this information and use it for statistical analyses or other specified business purposes, provided it is not personal data beyond the scope of basic master data or usage data.

8. Obligations of the user

As a user, when using or through the use of our websites, you must not

  1. violate common decency by the way you use our websites;
  2. use them for unlawful purposes;
  3. infringe on our intellectual property rights, copyrights or other proprietary rights;
  4. transmit any content containing viruses, in particular Trojans or other programs that could damage the software;
  5. enter, save or send any hyperlinks or content which you lack authorisation, in particular if such hyperlinks or content violate duties of confidentiality or are unlawful or if they disseminate advertising or unsolicited e-mails (spam), inaccurate warnings of viruses, malfunctions etc. or encourage participation in competitions, snowball systems, chain letters, pyramid schemes and similar campaigns.

For the avoidance of doubt, the foregoing list is merely by way of example. The above points also apply mutatis mutandis to references or links to such or similar content.

We are authorised to block access to our websites at any time, in particular if you as a user violate these General Terms of Use or other special agreements.

9. Use of VIYOUU products and services

The use of our products and services is subject to separate General Terms of Use.

These separate General Terms of Use shall also apply if the contracting party refers to its own terms and conditions.

10. Websites with login or access authorisation

You are obliged to protect your login / access authorisation against unauthorised access by third parties and to ensure that it is not used by other persons without your authorisation. You must inform VIYOUU immediately if you become aware of a breach of the security of our websites or of unauthorised use of your login data or if you have indications that such incidents may be occurring.

11. Data protection

For the purposes of the data protection regulations, the "controller" is VIYOUU Softwareentwicklung GmbH, FN 626108 y, Am Belvedere 4, A-1100 Vienna, which appears in the legal notice of the respective website.

If you provide personal data or information on our websites, we will use these within the scope of the research purpose stated on the respective website without your further consent. We will inform you separately about the use of such data or information for another purpose which accords with the purpose of our research. The data will only be used for advertising or marketing purposes or passed on to third parties with your separate consent.

The duration of data storage depends on the respective purpose. In general, personal data is deleted when further storage is no longer required to fulfil this purpose.

If you access content from external providers on our websites or switch to websites of external providers through our websites, we will pass on the data provided by the browser to that operator. We are generally not responsible for the content provided on such external sites, whether with regard to data protection or with regard to the technical security of the data and information provided. In connection with this, please note that external providers may use technologies to personalise advertising.

Data storage for technical reasons:

For technical reasons, certain data and information must be collected and stored when you visit our websites, e.g. the websites used, the time and duration of the visit and data provided by the browser used (e.g. on the operating system and the system settings used). We use such data and information anonymously to make our website as user-friendly as possible and to optimise it in technical respects.

In all other respects, the provisions of our privacy policy apply; visitors to our websites agree separately to the application of our privacy policy.

12. Miscellaneous

Any collateral agreements are only valid if made in writing.

Should individual provisions of these General Terms of Use be or become invalid or void, this shall not affect the validity of the remaining provisions. The invalid or void provision shall be replaced by a provision that comes closest to the commercial purpose of the invalid or void provision. This provision shall apply mutatis mutandis to gaps.

These General Terms of Use have no effect on the rights of consumers within the meaning of the Austrian Consumer Protection Act (KSchG).

VIYOUU reserves the right to amend these General Terms of Use from time to time. Newer versions supersede older versions of the General Terms of Use in their entirety.

The rights of the individual user arising from these General Terms of Use may not be assigned or transferred to third parties without the prior written consent of VIYOUU.

These General Terms of Use are subject exclusively to Austrian substantive law, excluding the conflict of law rules of private international law and the UN Convention on Contracts for the International Sale of Goods.

The place of performance is Vienna; exclusive jurisdiction for disputes is vested in the courts of Vienna, provided the case does not involve a consumer protection dispute.

Where personal terms are used in these General Terms of Use, they are not intended to have any gender-specific meaning. When applying the General Terms of Use, gender-specific form appropriate to the case should be deemed to apply.
